Update: Arlington Police Looking Into 'Every Component' of Moran Video

ARLINGTON, Va. -- Following the release of a video this week that shows Democratic U.S. Rep. Jim Moran's son, Patrick, apparently talking about ways to skirt voter identification laws, the Arlington County Police Department has opened a criminal investigation into the matter.

"Every component is under investigation right now," police spokesman Dustin Sternbeck said. "It's very early."

The video, released by conservative activist James O'Keefe — whose methods and productions have been called into question in the past — shows the younger Moran responding to requests for advice on how the unidentified cameraman can "vote for" 100 inactive voters. Patrick Moran, after suggesting the person's energy would be better used in more traditional — and legal — get-out-the-vote efforts, tells the man he'd have to forge documents, such as utility bills, to be successful. He also recommends the man call the voters, perhaps posing as a pollster, to be sure they are not, in fact, planning to vote.

Police and the Commonwealth Attorney's Office have been made aware of the video, which investigators described as depicting Patrick Moran "assisting another to vote illegally," according to a news release.

Police are not planning to take Patrick Moran into custody at this point, Sternbeck told Patch.

"I believe the first step would be to reach out to the individuals who produced the video," he said.

Sternbeck continued: "We're going to assign it to a detective, he's going to reach out to the individuals who produced the video and look at every component. Just as any investigation goes, you're going to have a starting point, involve both parties, come to a determination and hand those results over to the Commonwealth Attorney's Office, and they will decide whether they want to prosecute."

When asked about O'Keefe's credibility, Sternbeck said, "We'll find out, right? It would be irresponsible of us not to investigate. So, we're proceeding."

The video was shot in Arlington's Courthouse community, including inside the Cosi across from the Courthouse Metro and in the nearby Arlington County Democratic Committee headquarters. Mike Lieberman, chairman of the Arlington Democrats, issued a statement Wednesday night saying Patrick Moran has been asked not to return to that office.

Patrick Moran resigned from his father's reelection campaign hours after the video surfaced Wednesday. He released a statement Wednesday night saying he has never endorsed illegal or unethical behavior and that "At no point did I take this person seriously. He struck me as being unstable and joking, and for only that reason did I humor him."

State and federal laws govern elections. Sternbeck said he wasn't sure if local police had reached out to other agencies at this point.

The election is less than two weeks away. But that doesn't mean police necessarily have a deadline, Sternbeck said.

"It's our responsibility is to conduct a thorough investigation," he said.

Theo Stamos, the commonwealth's attorney for Arlington and Falls Church, declined to comment.

"That statement is that all that can be said publicly," Stamos said, citing Thursday's two-sentence news release. "It would be completely inappropriate to comment in any way on an investigation that is ongoing, which this clearly is."

Stamos, a Democratic elected official, would not say the extent her office would be involved in the investigation and any potential prosecution of Patrick Moran.

Last year, Stamos and then-Commonwealth's Attorney Dick Trodden asked a judge to grant a special prosecutor to avoid the appearance of a conflict of interest in a case involving a Falls Church political activist whom she had met through a mutual acquaintance. 

In a radio interview recorded Thursday on National Public Radio's "All Things Considered," Arlington County Republican Committee Chairman Charles Hokanson called on Jim Moran to resign.

“Speaking as a citizen and voter, every Arlingtonian should be concerned about attempts to destroy the integrity of the democratic process and to steal elections by illegal and unethical behavior,” Hokanson said, according to a news release.

“Reflecting on the broader implications of this potential voter fraud scandal, this really should be the scandal that finally crosses the line, even for Jim Moran, so that he should resign from Congress and leave public office immediately.

“The people of Arlington — Republicans, Democrats and Independents — will not tolerate potential voter fraud, and we demand of all our officials that they preserve the full integrity of our voting process, which has been held to a very high standard in this county. This is not our way. It’s time for Jim Moran to go — by resignation in disgrace, or by voter indignation at the voting booth on November 6.”

Earlier this week, Jim Moran and Reps. Bobby Scott and Gerry Connolly called on the U.S. Department of Justice to conduct a multi-state investigation following an incident in the Shenandoah Valley where a man allegedly threw a stack of voter registration forms in the trash.

Colin Small, a 31-year-old man working for the state Republican Party under contract, now faces 13 felony and misdemeanor counts of voter registration fraud in that case, according to NBC4.

Virginia Attorney General Ken Cuccinelli is investigating that matter at the request of the State Board of Elections, according to the (Hampton Roads) Daily Press.

Cuccinelli stated in a letter this week that he lacks the authority to investigate elections matters until formally asked to do so by the State Board of Elections, a local commonwealth's attorney, or a local electoral board member, according to NBC4.

A message sent to the State Board of Elections was not immediately returned Thursday afternoon. Messages left with Jim Moran's congressional office and campaign were not immediately returned.

I think you should leave NOW. If you think Benghazi was bad what about the Leabanon bombing under Reagan. What about the CIA field officer that was kidnapped and KILLED under Reagan? Were you a 1/2 American citizen then? What about the Republican contractor that thru away hundreds voter registration? Im sure they were onl Democrate party voters. That wasn't on Fox was it? So dont get up on a box and beat your chest and say how bad and enept the President is. As for Moran he was wrong if he intended to help in a illeagel activity. Bopth parties are guilty of voter fraud. Jebb Bush purged the voter rolls before Bush 2 was elected. An independate panel found that thousands of voters were removed from the rolls. The only reason is they had he same name as a convicted felon. This included minister, 80 year olds even police officers. It was uncovered that Gov. Bush was told the program was flawed. He did it anyway then when GW lost they came up with the hanging chad. So recient history shows that both polital parties will do anything for controll. If you don't like this way( I dont) you should move back to were ever your other citizenship is and give up your American citizenship. This is what our politcal system is now and dosent look like its going to get better.

Thanks but no thanks. Anyone claiming that bringing in "observers" from a corrupt organization that has failed to fulfill the most basic components of its mandate is in need of a reality check. Perhaps if you were willing to accept that what is sin for a Republican is sin for a Democrat as well we might take your moral judgments more seriously. A single act of voter fraud or seeming corruption is serious business.

I've got as many cops in my family as you lay claim to and after practicing law for thirty years (much of it defending cops in 42 USC 1983 cases) I've learned that cops who make comments about "real" crime as opposed to things they condone often end up with a union rep telling them to shut up before they get into even more trouble...

A politician that happens to be a Democrat is already arrested for that, voting in maryland and florida. almost like the several thousand dead voting for Franken in the last election. A president who tops 16 trillion in debt when he promised to halve it and who has the nerve to lie about what was known and when in Libya is the poster child for “inept.” Shame on you sir.

Using the dead to vote has been shown to be a frequent occurence with left wing politicians in chicago. Problem is is that it has been suspected in the past with Morans elections. We don't want it here. Dishonesty and multiple voting is a democratic party problem as shown by the maryland woman (another politician) that voted in both florida and maryland. Your lack of any honesty is obvious as you try to deflect it to the repubs. Funny, but that illness you are suffering from is obvious and telling. You and Alexis are both ridiculous. "Looked to me like someone (stupidly) trying to be nice to a supporter" "I didn't see anything incrimination (incriminating) on mr. moran's part." First of all, if this "good samaritan" was a member of the Republican party, both of you and many others on here, would be trashing and blaming Romney and calling for this man's father to resign immediately. Don't bother denying it. It IS a fact. Next, this young man was not "helping" this person or anyone who approaches for a way to commit voter fraud. Spin it any way you want, but it IS what it is. To teach anyone criminal behavior is NOT helping. It is aiding and abetting.

Mr. Spencer, the author of the piece above, once again shows his bias. Says Mr. O'Keefe's work has been discredited then links to an NPR story on the NPR video where an NPR person was outed. This is all well and good except for the fact that as usual Project Veritas also released the unedited version of the video Mr. Spencer says has been 'discredited'.

Another SMEAR JOB by James O'Keefe. So he goes up to a person and asks them how to commit a crime. The person tells them it is illegal but if he wanted to, here's how how to commit the crime.
Then O'Keefe uses the video to INSINUATE the person will committ the crime, or has committed the crime and the person is a criminal WITHOUT any evidence a crime was committed. Just having knowledge of how to commit voter fraud does not mean one is guilty of doing it. DUH! In order to PREVENT voter fraud one has to know how it is done! So if I go up to an Off Duty Police Officer and ask him what the best way would be to rob a store, and based on his years of experience, he tells me how it could be done, does that make the Cop a criminal, and mean he probably has robbed a store in the past? O'Keefe only asks these questions of DEMOCRATS, with the intent to smear them. He could even better advice on how to commit voter faud from Repulicans since they claim to have evidence of so much of it being committed. During the court hearing on the PA Voter ID Law, the Republicans did not submit any EVIDENCE of voter fraud to support their case.

Having to forge documents, etc., is not necessary in California - just walk past the conveniently posted roster of voters, select a name (and address) not already crossed out (they have voted), state to the pollworker that your name/address is the one you picked, sign the roster, you will be handed a ballot, fill it out, and it will be placed in the ballot box. Very simple to commit fraud - the pollworkers are forbidden to ask for identification. Then go to the next polling location and repeat this process all day long - in fact put together a team and pretty soon you can truly swing an election!

No many libs are going to find anything wrong with a little election fraud. ACORN operatives worked pretty much in this same fashion and were exposed. They disbanded or at least changed the name and at this moment are organizing how to get the extra votes they need in many districts. Free and fair election you know.

If what you way is true, which it isn't, then the right after the encounter Moran should have immediately contacted the authorities. He didn't and even though what he did might not rise to the level of being a prosecutable offense his action or lack thereof after the fact show exactly where his heart is! This is why photo I.D. for voting makes sense but since when do liberals worry about that?
